1. Our Terms of Service — About Our T’s and C’s
Our Terms of Service (the Terms) are a binding agreement between you and Platespace AU Pty Ltd [96 696 871 655] (PlateSpace).
PlateSpace is the provider of a digital platform at platespace.com.au and associated mobile applications (collectively, the Platform).
By using the Platform (which includes things such as: creating an account, accessing our webpage, or purchasing any product or service from PlateSpace), you agree to be bound by these Terms. If you do not agree, don’t use the Platform.
These Terms also incorporate other documents such as our Privacy Policy and may incorporate additional policies or procedures which Platespace publishes from time to time on the Platform, or which it may send to you using information you have provided.
In the event of inconsistencies between any of those documents, unless expressly stated, these Terms will prevail.
The Platform is intended for persons aged 18 years or older. By using the Platform, you represent that you are 18 or older, and if you are not 18, don’t use the Platform.
2. What We Do — the Platform
2.1 PlateSpace is an online listing and marketplace platform that enables registered sellers (Sellers) to advertise personalised and custom number plates issued by various Government bodies for sale to prospective buyers (Buyers). Unless expressly indicated to the contrary, PlateSpace is an intermediary only.
2.2 PlateSpace does not own any number plates listed on the Platform. PlateSpace is not a party to any agreement entered into between a Seller and a Buyer. PlateSpace is not a broker, advisor, agent, insurer, auctioneer, or financial intermediary.
2.3 PlateSpace has no control over and does not verify:
- the existence, condition, legal status, or transferability of any plates listed;
- the truth or accuracy of any listing content, images, or descriptions;
- a Seller’s legal right or authority to sell or transfer any number plate;
- a Buyer’s ability or intention to pay;
- compliance by either party with applicable state or territory road transport legislation regarding plate transfers;
- the outcome of any negotiation or transaction between Sellers, Buyers or registered users.
2.4 All transactions are conducted directly between Sellers and Buyers.
2.5 For the avoidance of any doubt, to the maximum extent permitted by law, PlateSpace disclaims any and all liability in connection with the conduct of Members and the outcome of any transaction.
3. Registering an Account with PlateSpace
3.1 To list a plate or make an offer you must register an account (Account). In creating and using an Account, you agree to provide accurate, current, and complete information and to keep it updated.
3.2 You are responsible for maintaining the confidentiality of your account credentials. You are liable for all activity that occurs under your Account.
3.3 PlateSpace reserves the right to suspend or terminate any Account at its absolute discretion, including for breach of these Terms, fraudulent activity, or conduct PlateSpace considers harmful to the Platform or its users.
3.4 You should not create an Account on behalf of another person without their express authorisation. By creating an account, you warrant and represent to PlateSpace that you have full authority to bind that person to these Terms.
3.5 PlateSpace is an Australian company which is intended for Australians. By using PlateSpace’s Platform, you represent and agree that you are in or connected to Australia, and acknowledge and agree that Australian Law shall apply to the exclusion of all other jurisdictions.
4. How PlateSpace Charges You — Listing Packages & Fees
4.1 Sellers may list number plates by purchasing one of the following listing packages. All prices are in Australian Dollars (AUD) and are inclusive of GST:

4.2 Each package includes only the features as described on the Platform at the time of purchase. PlateSpace reserves the right to amend package features or pricing, but will give you reasonable notice of any change of that nature. Any changes will not affect listings already purchased.
4.3 Listing fees paid to PlateSpace are non-refundable, save for as may be required by law, including but not limited to under the Australian Consumer Law (or as otherwise set out in these Terms).
4.4 Where a listing expires and the plate remains unsold, a Seller may re-list by purchasing a new package. PlateSpace may offer renewal discounts from time to time at its sole discretion.
4.5 Sellers with multiple active listings may be eligible for multi-listing discounts as advertised on the Platform from time to time.
4.6 Payment is processed via Stripe. PlateSpace does not directly obtain, receive or store your payment or card details. By purchasing a listing, you authorise the charge of the applicable fee to your nominated payment method.
5. Seller Obligations — What do Sellers Need to Know
5.1 By listing a plate on the Platform, the Seller represents and warrants to PlateSpace and any Buyer that:
- they are the lawful owner of the plate or have legal authority to sell it;
- the plate is not subject to any encumbrance, dispute, or restriction that would prevent its transfer;
- the listing content, including all images, descriptions, and pricing, is accurate, complete, and not misleading;
- they will comply with all applicable state and territory road transport laws governing the transfer of number plates; and
- the sale and transfer of the plate will not breach any applicable law.
5.2 Sellers must:
- include accurate images of the actual plates being listed or sold;
- accurately and fairly describe the plate condition and any defects;
- not list the same plate in more than one active listing on PlateSpace;
- promptly remove or mark as sold any listing after a sale is agreed;
- respond to Buyer inquiries in a timely and professional manner.
5.3 Sellers must not:
- use intellectual property they do not own, or have the rights to use;
- misrepresent the rarity, fair value, or provenance of any plate;
- list stolen, fraudulent, or otherwise illegally obtained plates;
- use the Platform for any purpose other than the legitimate sale of number plates.
6. Buyer Obligations — What do Buyers Need to Know
6.1 Buyers acknowledge and agree that:
- PlateSpace is not a party to any transaction and provides no warranty as to the accuracy of any listing;
- it is the Buyer’s sole responsibility to independently verify the legitimacy, transferability, and condition of any plate prior to completing any purchase;
- all transfer of ownership obligations, including dealings with the relevant State or Territory road transport Authority, are entirely the responsibility of the Seller and Buyer and not PlateSpace;
- offers made through the Platform are indicative only and do not constitute binding contracts until confirmed in writing by both parties outside the Platform.
6.2 Buyers must not:
- make frivolous or bad-faith offers;
- use the Platform for any purpose other than its intended purpose;
- attempt to contact Sellers outside the Platform to circumvent the listing system;
- engage in harassment or intimidation of any Seller.
7. Prohibited Conduct — Don’t Do This!
7.1 You must not use the Platform to:
- list or attempt to sell plates you do not own or have no authority to sell;
- engage in misleading, deceptive, or fraudulent conduct;
- post content that is offensive, defamatory, discriminatory, or in breach of any Australian law;
- use automated tools to scrape, copy, or extract Platform content;
- attempt to gain unauthorised access to any account, system, or data;
- interfere with the Platform’s operation or circumvent any security measures;
- use the Platform in any way that may breach the Australian Consumer Law, a part of the Competition and Consumer Act 2010 (Cth), or any other applicable laws.
8. Listing Content and Intellectual Property — Your Obligations and Representations
8.1 By uploading content (Intellectual Property) to the Platform (including images, descriptions, and other materials), you irrevocably licence PlateSpace a non-exclusive, royalty-free, worldwide licence to use, reproduce, display, and promote that content for the purpose of operating and marketing the Platform, including on social media, email communications, the Platform homepage, and reasonably connected services intended to enhance the Platform experience.
8.2 You retain ownership of your content, but you warrant that any content you upload does not infringe the intellectual property rights of any third party.
8.3 All Platform content, branding, software, design, and materials created by PlateSpace are owned by or licensed to PlateSpace. You may not reproduce, copy, or use them without prior written consent.
8.4 PlateSpace may use listing images and plate details for the Spotlight and Premier Showcase social media promotion features in accordance with the package description. By purchasing these packages you consent to such use.
9. Featured and Promoted Listings
9.1 Featured, Spotlight, and Premier Showcase listings are subject to the following:
- Featured:This means a priority ranking in search results — so the listing will appear higher in organic search results than standard listings, subject to PlateSpace’s ranking algorithm which may change from time to time. PlateSpace cannot and does not guarantee any specific search position.
- Spotlight:This means social media showcase posts will be published on PlateSpace’s official social media channels. PlateSpace makes no guarantee as to the reach, engagement, or commercial outcome of any social media post.
- Premier Showcase: This means a guaranteed homepage placement for your listing, which will appear in the dedicated homepage featured section for the duration of the listing. Promotional campaign analytics will be communicated to the Seller within a reasonable timeframe. Concierge listing assistance is provided on a best-efforts basis.
9.2 PlateSpace will use reasonable endeavours to deliver all promoted listing features. Where a feature cannot be delivered due to technical failure or circumstances beyond PlateSpace’s control, PlateSpace will offer a reasonable compensation, which may include a listing extension or partial refund at PlateSpace’s discretion.
9.3 You acknowledge and agree that PlateSpace’s liability in respect of any and all matters is expressly limited to the amount you paid to PlateSpace, and that PlateSpace shall not be liable for any consequential loss of any kind.
10. Our Refund Policy
10.1 Listing fees are non-refundable once you purchase from us, and a listing is live on the Platform, except where:
- PlateSpace is unable to publish the listing due to a technical error on its part;
- a promoted feature (e.g., homepage placement) is not delivered and no reasonable remedy is offered; or
- a refund is required under law, including pursuant to the Australian Consumer Law.
10.2 If your listing is removed by PlateSpace due to a breach of these Terms, no refund will be provided.
10.3 Refund requests must be submitted to platespaceinfo@gmail.com. You need to do this as soon as reasonably practicable, but not later than 14 days after the relevant issue arises. PlateSpace will respond within in reasonable time, but always within 5 business days.
11. Privacy and Data
11.1 PlateSpace collects and handles personal information in accordance with our Privacy Policy, available at platespace.com.au/privacy, and the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
11.2 By using the Platform, you consent to PlateSpace collecting your name, email address, contact details, payment information (processed by our payment provider), listing data, usage analytics, and other personal information.
11.3 PlateSpace will not sell your personal information to third parties. However, we may share your personal information or data with service providers or third parties (payment processors, email platforms, analytics tools) as necessary to operate the Platform or to enhance the service we provide.
11.4 The Platform’s messaging system allows Buyers and Sellers to directly communicate. Your contact details will not be disclosed to other users unless you choose to share them. PlateSpace monitors Platform communications for compliance with these Terms.
12. Disclaimer and Limitation of Liability — The Legal Stuff
12.1 The Platform is provided on an “as is” and “as available” basis. PlateSpace makes no representations or warranties as to the reliability, accuracy, or completeness of any listing content or Platform information.
12.2 PlateSpace is not, and shall not be liable for:
- any loss or damage arising from a transaction between a Seller and Buyer;
- the failure of a Seller to transfer a plate in accordance with state or territory legislation;
- the accuracy of any plate description, valuation, or image;
- any indirect, consequential, special, or punitive loss or damage, including loss of profit or loss of opportunity;
- any Platform unavailability, technical failure, or data loss.
12.3 To the maximum extent permitted by law, PlateSpace’s total aggregate liability to any user for any claim arising under or in connection with these Terms or the Platform is limited to the amount paid to PlateSpace in respect of the service provided, or alternatively as paid to PlateSpace by that user in the 12 months preceding a claim.
12.4 Nothing in these Terms limits or excludes any guarantee, right, or remedy that cannot be excluded by law, including any rights or remedies pursuant to the Australian Consumer Law.
13. Indemnity
13.1 You agree to indemnify, defend, and hold harmless PlateSpace and its officers, directors, employees, and agents from and against any claims, damages, losses, costs (including reasonable legal fees), and expenses arising out of or in connection with:
- your use of the Platform in breach of these Terms;
- any content you post on the Platform;
- any transaction you enter into through the Platform;
- your breach of any applicable law, including road transport legislation governing plate transfers.
14. Disputes Between Members
14.1 PlateSpace is not a party to disputes between Sellers and Buyers. PlateSpace encourages Members to resolve disputes directly and in good faith.
14.2 PlateSpace may, at its sole discretion, assist or otherwise provide a mediation process to assist Members in resolving disputes. Any such assistance does not constitute legal advice and does not make PlateSpace liable for any conduct or outcome.
14.3 Any claim by a Member against PlateSpace must be commenced within 12 months of the event giving rise to the claim.
15. Termination
15.1 PlateSpace may suspend or terminate your Account and any active listings at any time if you breach these Terms, engage in fraudulent conduct, or if PlateSpace determines continued access is contrary to the interests of the Platform or its users. PlateSpace may also suspend or terminate your Account and any active listings if it reasonably believes that you may have breached these Terms, engaged in fraudulent conduct, or if PlateSpace determines continued access is contrary to the interests to PlateSpace, the Platform, or its users.
15.2 You may close your Account at any time by contacting platespaceinfo@gmail.com. Closing your Account does not entitle you to a refund of any listing fees already paid.
15.3 On termination, your licence to use the Platform ceases immediately. Sections 8, 12, 13, 14, and 16 survive termination.
16. General Provisions
16.1 Governing Law. These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.
16.2 Amendments.PlateSpace may amend these Terms at any time by posting an updated version on the Platform. Continued use of the Platform after the effective date constitutes acceptance of the amended Terms. For material changes, PlateSpace will provide at least 14 days’ notice by email, or by way of posting amended Terms on the Platform.
16.3 Severability. If any provision of these Terms is found to be invalid or unenforceable, it will be severed without affecting the remaining provisions.
16.4 Entire Agreement. These Terms, together with the Privacy Policy and any other published policies, constitute the entire agreement between you and PlateSpace regarding your use of the Platform.
16.5 No Waiver. Failure by PlateSpace to enforce any provision of these Terms does not constitute a waiver of that right.
16.6 Force Majeure. PlateSpace is not liable for any failure to perform its obligations caused by events beyond its reasonable control, including natural disasters, telecommunications failures, or government action.
